The Osun Tribunal demands that INEC provide Adeleke’s results.
The Independent National Electoral Commission (INEC) Chairman, Prof. Mahmoud Yakubu, was ordered to produce Sen. Ademola Adeleke’s election results from the 2018 Osun governorship election by the Osun Election Petitions Tribunal, which is based in Osogbo.
The document tagged: “INEC Form CF001” is being demanded by Counsel for the All Progressive Congress (APC), the Petitioners.
In his ruling on the arguments and counterarguments made by the petitioners’ and respondents’ counsel regarding the INEC Form CF001, the Tribunal Chairman, Justice Tertsea Kume, issued the order.
After the respondent (INEC) failed to comply with the subpoena order as regard to what the petitioners were demanding, Kume stated that it would amount to denying the petitioners their right to a fair hearing.
He claimed that the Form CF001 was not produced by the Osun Resident Electoral Commissioner, Dr. Mutiu Agboke, who was represented by Shehu Muhammed, citing a lack of custody of the document in the state as the reason.
According to the tribunal chairman, the petitioner had provided sufficient justification for their application or subpoena request.
On the following adjournment date, he ordered INEC Chairman to present the document.
As a result, Kume postponed the case’s hearing until December 1.
The News Agency of Nigeria (NAN) reminds readers that the Tribunal rejected the respondents’ (INEC) oral request to discountenance a subpoena issued by the petitioner on November 16.
NAN also states that the respondent initially filed a response to the subpoena request, withdrew it for private reasons, and the tribunal struck it down.
